These Privacy Policy and Terms of Service (“Agreement”) govern your access to and use of TADE (the “App”) provided by Mike Kruzich (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to this Agreement. If you do not agree, please do not use the App.

1. Privacy Policy

1.1 Information We Collect

Information You Provide Directly. When you register or use certain features, we may collect your name, email address, chosen username, password, and any profile details you submit. Health & Fitness Data. You may log personal goals and tracking data (e.g. abstinence records, progress metrics). This sensitive information is stored securely and used solely to provide and improve the App’s core functionality. Usage and Device Data. We automatically collect diagnostic, crash, and performance data; device model; operating system version; and anonymized usage metrics to optimize the App. Communications. If you contact support or provide feedback, we retain your communications to resolve your inquiries.

1.2 How We Use Information

To Provide & Improve the App. Enable core features, personalize your experience, and develop new functionality. Diagnostics & Analytics. Monitor, debug, and analyze usage patterns. We use industry-standard analytics providers. Communications. Send you account-related notices, security alerts, and updates (you may opt out of non-critical emails).

1.3 Information Sharing & Disclosure

Service Providers. We may share data with third parties performing services (hosting, analytics, email delivery) under confidentiality obligations. Legal Compliance. We may disclose information to comply with laws or protect rights if required by subpoena, court order, or government request. Business Transfers. In connection with a merger, acquisition, or sale of assets, data may be transferred to the successor entity, with notice to you.

1.4 Data Retention & Security

We retain your personal and health data as long as your account is active or needed to provide services. We employ administrative, technical, and physical safeguards to protect data, including encryption in transit and at rest.

1.5 Your Rights

Access & Correction. You may review or update your account information via your profile settings. Deletion & Portability. You may request deletion of your account and data by contacting us at the address below. California Residents. Subject to CCPA, you may request disclosure of categories of personal information collected or opt out of “sale” of personal information (we do not sell user data).European Residents. Under GDPR, you have rights to access, correct, delete, restrict processing, data portability, and to lodge a complaint with a supervisory authority.

1.6 Children’s Privacy

The App is intended for users aged 18 or older. We do not knowingly collect data from minors under 18. If you believe we have inadvertently collected data from a minor, please contact us to have it deleted.

1.7 Changes to Privacy Policy

We may update this section; material changes will be posted with a new effective date. Continued use after changes constitutes acceptance.

2. Terms of Service

2.1 Acceptance of Terms

By accessing or using the App, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, do not use the App.

2.2 Eligibility

You must be at least 18 years old to use the App. By agreeing, you represent and warrant that you meet this requirement.

2.3 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes, subject to this Agreement.

2.4 User Conduct

You agree not to:

Reverse-engineer, decompile, or attempt to derive source code. Use the App for unlawful or harmful purposes. Interfere with the operation of the App or any user’s enjoyment. Upload or transmit any content that is infringing, defamatory, obscene, or otherwise objectionable.

2.5 Intellectual Property

All App content, features, and functionality are owned by us or our licensors and are protected by copyright, trademark, and other laws. You acquire no rights in the App other than the license granted in Section 2.3.

2.6 Third-Party Links & Services

The App may contain links to third-party websites or services. We are not responsible for their content or practices; your use is at your own risk.

2.7 Termination

We may suspend or terminate your access for any reason, including breach of this Agreement. Upon termination, your license ends and you must cease using the App.

2.8 Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

2.9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

2.10 Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising from your breach of this Agreement or your misuse of the App.

2.11 Changes to Terms

We may modify this Agreement at any time. We will notify you of material changes by posting an updated date at the top. Continued use constitutes acceptance of the revised terms.

2.12 Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising will be resolved in the state or federal courts located in Riverside County, California.
