Terms of Service for TADE

Welcome to TADE. These Terms of Service (“Terms”) are a binding legal agreement between you (“User,” “you,” or “your”) and Michael Kruzich (“TADE,” “we,” “us,” or “our”), governing your access to and use of the TADE mobile application (the “App”).

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years of age to download or use the App. By using the App, you represent and warrant that you meet this age requirement and are legally able to enter into this Agreement.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on your iOS device strictly in accordance with these Terms. You may not:

Reproduce, modify, distribute, or create derivative works based on the App;

Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App;

Use the App for any illegal or unauthorized purpose;

Use the App in a manner that could interfere with, disrupt, or negatively affect other users.

3. User Conduct

You agree to use the App only for lawful purposes. You agree not to:

Upload, post, or transmit any content that is unlawful, offensive, or harmful;

Harass, threaten, or impersonate others;

Use the App in a way that could damage, disable, or impair the App’s functionality or interfere with any other party’s use of the App.

4. Intellectual Property

All content, trademarks, logos, and intellectual property in the App are owned by or licensed to us and are protected by copyright and other intellectual property laws. Your use of the App does not grant you any ownership or rights in the App or its content beyond the limited license provided in Section 2.

5. Third-Party Services

The App may contain links or integrations to third-party websites or services. We are not responsible for the content, terms, or privacy practices of any third-party services. Use of these services is at your own risk and governed by their own terms and policies.

6. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will immediately cease, and you must delete the App from your device.

7. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP.

9. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of a third party.

10. Updates and Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Last Updated” date and, where appropriate, by providing in-app notification. Continued use of the App after changes means you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Riverside County, California, for any legal proceedings related to these Terms or your use of the App.
